What should you do if your employer withholds your documents or does not pay your salary?

Unfortunately, such situations happen more often than we would like

Withholding documents or delaying salary is a serious violation of your labor rights. The Mykolaiv “Lyubystok” Foundation knows how to act in such cases to protect yourself and regain control of the situation.

Your rights under Ukrainian law:

  • No document that proves your identity or confirms your employment can be kept by the employer. Your passport, employment record book, diplomas, residence permit, and tax ID must always be with you.
  • Salary must be paid on time. It should be paid at least twice a month. Any delay is a violation, and compensation is accrued on the amount owed.

Steps to take if your employer violates your rights:

  1. Submit a written request for the return of documents or payment of salary. Keep copies of requests, messages, and letters.
  2. Document all violations. Screenshots of correspondence, photos, recordings — all of these can serve as evidence.
  3. Contact the State Labor Service (Derzhpratsi). They can conduct an inspection of the employer.
  4. If your passport or other documents are being withheld — contact the National Police. Withholding a passport is illegal.
  5. File a lawsuit. This can be for salary recovery as well as compensation for delays.
